General Terms and Conditions (GTC) for events organized by "Tonhain GmbH"

I. Scope of application

The following General Terms and Conditions apply to all concerts organized by "Tonhain GmbH" (hereinafter referred to as the "Organizer"). They govern the contractual relationship between the purchaser and holder of tickets and the "Tonhain GmbH". Any deviating general terms and conditions of the ticket purchaser or holder shall not apply.

II. Purchase of tickets

The purchase of tickets for events organized by "Tonhain GmbH" is only possible via the following channels:

a) Online advance sale

The online advance sale of tickets is only possible via the official website of the Organizer (www.tonhain.com). Under the heading "Concerts & Tickets", tickets can be ordered via a ticket store of the service provider "Stripe" linked on the organizer's website no later than 10 weekdays before the start of the event. The purchase amount for the tickets ordered, including the fees included therein, is due for payment immediately.

After payment has been made, the purchaser will receive an e-mail ticket that can be printed out directly. The purchase contract between the organizer and the ticket purchaser is only concluded after payment has been made. The online purchase of tickets is only possible up to 24 hours before the start of the event.

b) On-site advance ticket sales

On-site advance ticket sales are not offered.

c) Box office

After advance ticket sales have closed, tickets can only be purchased at the box office at the higher box office fee. The admission price must always be paid in cash.

III. Right of withdrawal and return

Exchanges or returns of purchased tickets are excluded. This also applies to tickets purchased in advance online sales, as there is an exception to the right of revocation and return otherwise existing in distance selling transactions in the area of leisure activities with a fixed time of performance in accordance with Section 312 g (2) sentence 1 no. 9 BGB, as well as for the loss of tickets by the customer.

In the event of cancellation of the event by the organizer as well as a cancellation, the full purchase price will be refunded upon presentation of the purchased tickets or the confirmation of payment. Refunds shall be made in cash if the tickets are purchased in cash, or by bank transfer to an account to be specified by the customer if payment is made by PayPal or credit card.

IV. Resale of tickets

Private resale of tickets is permitted; commercial resale is generally prohibited.

V. Data protection

"Tonhain GmbH" will treat the data provided by the ticket purchaser confidentially. We collect, process and use the data collected during the ticket purchase process within the applicable legal limits for the purpose of providing our services. "Tonhain GmbH" is entitled to transfer the data provided to third parties commissioned to carry out the order, insofar as this is necessary to fulfill the order.

VI Other regulations

Access to events is only permitted with a valid admission ticket. Children and young people under the age of 16 may only enter if accompanied by a parent or guardian. When purchasing discounted tickets, valid proof must be presented upon entry.

The organizer has no influence whatsoever on the design, length, content and volume of the event.

The making of any kind of image and sound recordings, including for private use, is strictly prohibited. This also applies to the use of cell phones or other devices with corresponding functions for the purpose of image and sound recording.

The perpetrator is liable for any damage caused by visitors to the events to furnishings, equipment or other facilities at the event venue.

The instructions of the security staff must be followed. In the event of non-compliance, the organizer reserves the right to immediately exclude the participant from the event without refunding the admission price.

Distributing right-wing extremist slogans and wearing such symbols will result in immediate exclusion from the event without refunding the admission price.

The admission ticket loses its validity upon leaving the venue.

The organizer reserves the right to relocate the event within the area of the city of Berlin.

In this case, the tickets remain valid and cannot be returned.

The organizer is not liable for damaged, lost, stolen or otherwise misplaced items.

By purchasing a ticket, the purchaser agrees that the concert may be recorded audiovisually or streamed live. The purchaser hereby expressly authorizes the recording or live streaming of the concert to include his/her person and image material.

VII. Final provisions

The law of the Federal Republic of Germany shall apply. Place of fulfillment and jurisdiction is Berlin. By purchasing an admission ticket, you accept these GTC as binding. Should one or more provisions of these GTC be invalid, this shall not result in the invalidity of the entire contract. The invalid provision shall be replaced by the relevant statutory provision.
